以上是英國刑法上傳統的4大犯罪分類（English criminal law has been classified as“ treason, felony and misdemeanor”with a tentative fourth class described as“summary offense”[1]) 。也有人也將summary offense歸類于輕罪，認為它是輕罪的一個亞類。在美國，前三種犯罪的分類與英國相同，只是summary offense 被有些人稱為petty offense，即“簡易程序審判罪”，其完全等同summary offense。

在這4種犯罪中，treason為“叛國罪”，指以發動戰爭或勾結外敵之手段，陰謀危害國家主權、領土完整和安全、推翻國家政府的犯罪行為（The offense of attempting to overthrow the government of the state to which one owns allegiance, either by making war against the state or by materially supporting its enemies [2])，treason被視為最嚴重的犯罪之一，一般都處以重刑，也稱為high treason、alta proditio。

Felony為“重罪”，指最少處一年，最高刑可處以死刑（如在美國的Louisiana州），且在普通法上可并處沒收其財產的嚴重犯罪。其最初甚至包括treason，現主要包括諸如：murder， rape，arson，burglary 等犯罪，也稱為 major crime 和 serious crime [3]。

Misdemeanor曾用于指除treason和felony之外的所有犯罪，misdemeanor與felony適用之實體法原則和程序法原則曾一度差別極大，對 misdemeanor 的處罰多以 fine，penalty, forfeiture 或處短期監禁等（關押之場所為jail而非prison)。在美國，也被稱為 minor crime 或 summary offense (而 summary offense 則被稱為 petty offense，參見上文）。
